Terms and Conditions
Please read these Terms and Conditions (“Agreement”) carefully before engaging the services of BANN Home Electrical & Heat Pump Services LLC (“Company,” “we,” “us,” or “our”). This Agreement sets forth the terms and conditions governing the provision of residential electrical, heat pump, EV charger, panel upgrade, troubleshooting, repair, installation, maintenance, and related services by BANN Home Electrical & Heat Pump Services LLC to its customers (“Customer,” “you,” or “your”). By engaging our services, scheduling an appointment, approving an estimate, or allowing work to begin, the Customer agrees to be bound by the following terms and conditions:
Payment Terms:
a. The Customer agrees to pay the Company for all services, labor, materials, equipment, permits, diagnostic work, and related charges at the agreed-upon rates.
b. Payment is due upon completion of the services, unless otherwise agreed upon in writing.
c. The Company may accept cash, checks, credit cards, debit cards, electronic payments, financing payments, or other approved payment methods. Credit card, financing, or electronic payments may be subject to additional processing fees where permitted by law.
d. Estimates, proposals, and invoices are based on the scope of work known at the time they are prepared. Additional work, unforeseen conditions, code requirements, equipment needs, or customer-requested changes may result in additional charges.
e. In the event of non-payment, the Customer shall be responsible for all costs and expenses incurred by the Company in collecting outstanding amounts, including but not limited to collection costs, court costs, reasonable attorney fees, and other applicable expenses.
Warranty Terms:
a. The Company provides a 2-year workmanship guarantee on labor performed by the Company, unless otherwise stated in writing on the applicable estimate, invoice, proposal, service agreement, or manufacturer documentation.
b. The workmanship guarantee covers defects in workmanship directly related to services performed by the Company.
c. Manufacturer warranties for equipment, parts, heat pumps, electrical devices, breakers, panels, EV chargers, controls, accessories, and other materials are provided by the applicable manufacturer and are subject to the manufacturer’s terms, conditions, registration requirements, and exclusions.
d. To make a warranty claim, the Customer must promptly notify the Company in writing or by contacting the Company directly and must allow the Company a reasonable opportunity to inspect the issue and determine whether it is covered.
e. The Company’s liability under any workmanship warranty is limited to repair or correction of the covered defective workmanship, at the Company’s sole discretion.
f. Warranty coverage does not apply to work, materials, systems, equipment, or conditions not installed, supplied, serviced, or approved by the Company.
Exclusions:
a. The warranty does not cover damages, failures, or issues caused by misuse, abuse, neglect, lack of maintenance, improper operation, customer modifications, or failure to follow manufacturer or Company instructions.
b. The warranty does not cover damages or failures caused by acts of nature, power surges, lightning, fire, flooding, freezing, corrosion, pest damage, vandalism, accidents, structural movement, utility issues, or other events outside the Company’s control.
c. The warranty does not cover pre-existing electrical, mechanical, heat pump, wiring, panel, circuit, code, structural, or system issues that were not part of the specific scope of work performed by the Company.
d. The warranty does not cover repairs required because of concealed conditions, outdated wiring, unsafe panels, improper prior work, lack of code compliance, insufficient capacity, or defects in existing systems.
e. The warranty does not cover routine maintenance, cleaning, filter replacement, condensate drainage issues caused by lack of maintenance, user settings, refrigerant issues caused by outside damage, or normal wear and tear.
Warranty Exclusions and Limitations:
a. Except as expressly stated in this Agreement or in a written warranty issued by the Company, the Company makes no additional warranties, express or implied.
b. The Company shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of use, loss of comfort, loss of income, loss of data, utility costs, temporary housing, spoiled goods, or damages arising from delays.
c. The Company’s total liability under this Agreement shall not exceed the amount paid by the Customer for the specific services giving rise to the claim.
Alterations:
a. Any alterations, modifications, repairs, adjustments, relocation, tampering, or additional work performed by anyone other than authorized Company representatives may void the Company’s warranty.
b. The Customer must obtain written consent from the Company before making any alterations or modifications to work performed by the Company if the Customer wishes to preserve warranty coverage.
c. The Company is not responsible for damage or failure caused by third-party contractors, homeowners, tenants, property managers, utility providers, manufacturers, or other persons not under the Company’s control.
Late Payment Fees:
a. In the event of late payment, the Customer may be subject to a late payment fee of 6% per month on the outstanding balance, or the maximum rate allowed by law, whichever is lower.
b. The late payment fee shall accrue from the payment due date until the outstanding balance is paid in full.
c. Payments are due upon completion of work unless otherwise agreed in writing. A late payment fee may be added 7 days after the payment due date.
d. The Company reserves the right to suspend service, warranty work, future scheduling, or release of documents until all outstanding balances are paid in full.
Scheduling and Delays:
a. The Company will make reasonable efforts to adhere to agreed-upon schedules, appointment windows, and project timelines.
b. Appointment times and project dates are estimates only and may be affected by emergency calls, weather, permitting, inspection schedules, supplier delays, equipment availability, illness, labor shortages, unsafe conditions, customer delays, utility coordination, or other circumstances beyond the Company’s reasonable control.
c. The Company shall not be liable for delays or failure to perform due to circumstances beyond its control.
d. The Customer agrees to provide reasonable access to the property at the scheduled time. Missed appointments, inaccessible work areas, locked gates, unsafe conditions, or customer-caused delays may result in additional charges.
Permits, Code Compliance, and Inspections:
a. The Company performs work in a manner intended to comply with applicable codes, laws, regulations, and industry standards within the agreed scope of work.
b. Where permits or inspections are required, the Customer agrees to cooperate with the Company, local authorities, utility providers, and inspectors as needed.
c. Permit fees, inspection fees, utility fees, engineering fees, and code-required upgrades may be billed to the Customer unless otherwise stated in writing.
d. The Company is not responsible for correcting unrelated code violations, pre-existing unsafe conditions, unpermitted prior work, or issues outside the approved scope unless the Customer authorizes such work in writing.
Heat Pump, Electrical, and Equipment Conditions:
a. Electrical and heat pump systems may contain hidden or pre-existing conditions that cannot be fully identified until work begins. These may include outdated wiring, damaged circuits, improper grounding, insufficient panel capacity, concealed damage, refrigerant line issues, drainage issues, or prior improper installation.
b. If hidden or unforeseen conditions are discovered, the Company may recommend additional work and provide pricing for Customer approval before proceeding, except where immediate action is required for safety.
c. The Company is not responsible for the performance of existing equipment, existing ductless systems, existing wiring, existing panels, utility service, or customer-supplied materials unless specifically included in the written scope of work.
d. Customer-supplied equipment or materials are not warranted by the Company, and the Company may decline to install materials that are unsafe, incompatible, damaged, used, counterfeit, or not code-compliant.
Rebates, Financing, and Incentives:
a. The Company may assist Customers with available rebates, financing options, or incentive paperwork where applicable.
b. Rebates, incentives, tax credits, and financing approvals are subject to third-party program rules, eligibility requirements, funding availability, deadlines, inspections, documentation, and approval by the applicable provider.
c. The Company does not guarantee that the Customer will qualify for any rebate, tax credit, incentive, or financing program unless expressly stated in writing.
d. The Customer remains responsible for reviewing program requirements and for any balance not covered by rebates, incentives, financing, or third-party payments.
Liability and Limitations:
a. The Company shall not be liable for any damages, losses, or expenses incurred by the Customer or any third party arising out of or in connection with the provision of services, except as expressly provided in this Agreement.
b. The Company’s total liability under this Agreement, whether in contract, tort, negligence, warranty, statute, or otherwise, shall not exceed the total amount paid by the Customer for the specific services giving rise to the claim.
c. The Company shall not be responsible for damage to concealed pipes, wires, structural components, finishes, landscaping, underground utilities, or other hidden conditions that could not reasonably be identified before work began.
d. The Customer acknowledges that troubleshooting, diagnostics, repair work, and installation work may require opening panels, walls, ceilings, equipment covers, or other areas, and that additional repair or restoration work may be required.
Customer Responsibilities:
a. The Customer shall provide safe, clear, and reasonable access to the work area, electrical panel, equipment, attic, basement, crawlspace, exterior units, parking areas, and other areas necessary for the Company to perform the services.
b. The Customer shall ensure that pets, children, tenants, guests, and other persons remain away from the work area for safety.
c. The Customer shall remove or protect valuable, fragile, sentimental, or delicate items from the work area before work begins.
d. The Customer is responsible for disclosing known issues, prior work, water intrusion, structural concerns, hazardous materials, pest activity, access limitations, or other conditions that may affect the work.
e. The Customer shall provide accurate contact information and promptly respond to scheduling, approval, payment, and project communications.
Changes and Amendments:
a. Any changes or amendments to the approved scope of work must be agreed upon in writing by the Customer and the Company.
b. The Company reserves the right to modify or update these Terms and Conditions at any time. Updated terms shall be effective upon posting to the Company’s website or providing notice to the Customer.
c. If there is a conflict between these Terms and Conditions and a written estimate, invoice, proposal, or signed service agreement, the more specific written document shall control for that specific job.
Termination:
a. Either party may terminate this Agreement upon written notice in the event of a material breach by the other party that remains uncured for a period of 30 days.
b. The Company may terminate or suspend services immediately if the Customer fails to pay, refuses required safety or code-related work, creates unsafe working conditions, interferes with the work, or engages in threatening, abusive, or inappropriate conduct.
c. Upon termination, the Customer shall pay for all services, labor, materials, equipment, permits, restocking fees, mobilization, diagnostic work, and other costs incurred up to the termination date.
Dispute Resolution:
Any disputes arising out of or in connection with this Agreement shall first be addressed through good-faith negotiations between the parties. If the parties are unable to resolve the dispute, the dispute shall be handled in accordance with the laws of the State of Maine. Unless otherwise required by law, venue shall be in a court of competent jurisdiction in Cumberland County, Maine.
Force Majeure:
The Company shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, storms, flooding, fire, war, terrorism, strikes, labor disputes, supply shortages, equipment shortages, utility delays, inspection delays, permit delays, illness, government orders, natural disasters, or other events beyond the Company’s control.
Confidentiality:
The Customer agrees to keep confidential any proprietary, pricing, technical, business, or confidential information disclosed by the Company during the provision of services, except as required by law.
Severability:
If any provision of this Agreement is deemed invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
SMS Messaging Terms:
